Product Liability Insurance

This policy indemnify the insured against all sums which the Insured becomes legally liable to pay as damages in respect of:

• All physical injury to any person including death sickness disease or disability.
  
• Partial or total physical destruction of tangible property.
• Legal costs and expenses incurred with the written consent of the Company in defense of any such claim.

Caused by:

Any Product designed, sold, supplied, installed, erected, repaired, altered or treated by the Insured and occurring within the Territorial Limits and during the Policy Period or Retroactive Period (if any) as stated in the schedule

The limit of liability will be liable for the product in order to pay compensation related to

• All physical injury to any person including death sickness disease or disability.
• Partial or total physical destruction of tangible property.
• Legal costs and expenses incurred with the written consent of the Company in defense of any such claim.

Your premium may vary, depending on:

1. Limit of Liability
2. Product insured
3. Territorial limit
4. Loss experience
5. Special extension
6. Other factors

Key Exclusion

The Company will not indemnify the Insured in respect of:

1. liability arising out of bodily injury of any person under  a contract of service or apprenticeship with the Insured if such Bodily Injury is arising out of and in the course of the employment of such person by the Insured or insured’s legal liability under workmen’s compensation act B.E.2537.
   
2. legal liability arising out of infringement of plans, copyright, patent, trade name, trade mark or registered design;
   
3. liability assumed by the Insured by agreement and which would not have attached in the absence of such agreement;
   
4. Fines, penalties, punitive exemplary aggravated or treble damages or any other damages resulting from the multiplication of compensatory damages;
   
5. The cost of recall of Products, withdrawn from the market or from use because of any known or suspected defect and in respect of inspection, repair, replacement or loss of use of goods, designed, sold, supplied, installed, erected, repaired, altered or treated in whole or in part by the Insured;
6. Damage to the Insured Products where such damage is due to any defect  or the harmful nature or unsuitability of  
   1. any Products which are part of or form a proportion of the Insured Product.
   2.  the Insured Products which are part of or form a proportion of any other Products.
7. Legal liability arising out of
   
   1. mining, processing, manufacturing, distributing, storage and/or removal of pure asbestos and/or Products made entirely or mainly of asbestos;
   2. use of Products made entirely or mainly of asbestos;
8. Legal liability, whether loss or damage directly or indirectly caused by, or arising out of or aggravated by war, invasion, act of foreign enemy, hostilities (whether was be declared or not) civil war, rebellion, mutiny, revolution, insurrection, military or usurped power, riot or civil commotion, martial law or any events relevant to martial law, terrorism or sabotage;
9. Claims arising out of public liability or professional indemnity of whatsoever kind;
10. Financial loss of any person not directly resulting from Bodily Injury and/or Loss of or  Damage to Property as a result of  an Occurrence.
